    O IPTU verde no município de Jales/SP

    The green IPTU is a tax that is levied on urban properties and makes up what is called the tax burden. It was implemented in the municipality of Jales/SP on November 11, 2009, to serve as a bonus for taxpayers, granting tax discounts to those who adopt certain sustainable practices provided for in Municipal Law No. 3,686/2009. Through this research, the Technical Manual for requesting Green IPTU in the municipality of Jales/SP was developed with the aim of covering all Urban Territorial Property Tax (IPTU) taxpayers in the municipality of Jales/SP, who seek a reduction in their burden. tax, as well as improving quality of life, minimizing environmental impacts. The purpose of the Manual is to inform the taxpayer what Green IPTU is about, what measures must be adopted to grant the discount, the advantages of this tax incentive and the procedure to be adopted to request the benefit. Its objective is to promote an incentive for owners to fulfill the social function of the property, benefiting society and the public sphere, through small ecological and environmentally friendly adaptations. To develop this work, a bibliographical review was carried out on IPTU, sustainability, municipal legislation and municipal data. The images and pictures used in the manual were created with the help of the CANVA website and artificial intelligence. The reduction in the value of IPTU is the main incentive to join the program, but the benefits of an ecological home extend to saving water and energy, which has a positive effect on the budget in the long term. It is concluded that the tax benefit presents both economic and environmental efficiency results.

    Crime ambiental praticado pelo poder público municipal: uma análise sobre a aplicabilidade da Lei de Improbidade Administrativa

    The present paper approaches the relationship between the State and the environment, aiming to evaluate the inquiries opened by the Public Ministry of the State of São Paulo (MPSP) and by the Federal Public Ministry (MPF) of Jales of the 24th and 37th Federal Judiciary Subsection and verify the coercion and sanction of environmental crimes of acts and/or omissions of municipal public agents (mayors) in the face of the Administrative Improbity Law (LIA) arising from environmental damage. The study was carried out by collecting data from the MPSP and MPF from 48 municipalities in the northwest region of São Paulo, from procedures opened from January 2008 to August 2021 whose defendants were mayors and municipalities. After data collection, there was a tabulation and correlation with the bibliography, legislation and found jurisprudence. The opening of 120 procedures by the MPSP was identified, of which 90% were civil inquiries, 10% police inquiries and 606 procedures by the MPF of Jales, of which 99.8% of the open inquiries evolved into public civil actions. It is concluded that the MPSP of the districts and MPF of Jales have been fulfilling the constitutional duty in environmental protection, however, it was identified that the mayors end up not suffering sanctions from the Administrative Impropriety Law for environmental crimes. It was identified that the main purpose of the Federal or State Public Prosecutor’s Office is the repair of the damage and the cease of the activity that generates the damage, and not the agent’s coercion that performs or omits actions that generate the environmental damage.

    Educação ambiental crítica: proposta de um método de ensino e aprendizagem pelas histórias em quadrinhos

    Human beings interact with the environment, sometimes putting it at risk. Environmental education is shown as an alternative to alleviate this harmful situation, especially if developed through attractive and playful languages for students, such as comic books. The present dissertation - derived from qualitative and bibliographic research - aims to provide Elementary School 1 teachers with a method of teaching and learning critical environmental education based on the teacher's self-application of a standard questionnaire that enables him to critically approach environmental-themed comics with students in a more politicized and less naive way.

    Educação ambiental e direito ambiental: proposta de planos de aula

    The necessity of adopting a biocentric perspective, which should guide all human activities to avoid environmental collapse, requires clear direction. This guidance can be found in the analysis of principles aimed at the environment, capable of promoting reflection and action on the relationships between a critical environmental education and human activities. In this way, the importance of environmental education in disseminating these principles becomes clear, especially among high school and technical education students. With education on environmental principles, it is possible to foster awareness of the need to preserve and conserve the environment, as well as to seek sustainable living alternatives, forming ecological citizens. In this context, the goal of this article is to elaborate a proposal for an Environmental Law Education Program, based on the creation of a lesson plan on environmental principles, aimed at high school and technical education teachers. The proposal aims to offer thematic, methodological, and bibliographical suggestions for their classes on the subject. As a methodology, a qualitative approach and a bibliographical and documental design were adopted, with the reading of scientific articles, books, doctrines, codes, and other documents, to collect programmatic content and elaborate a lesson plan that will be made available free of charge to interested teachers and schools.

    Termo de ajustamento de conduta em conflitos ambientais para promoção das políticas de saúde única

    Based on the need to promote social well-being and environmental preservation, this study seeks to demonstrate the prophylactic nature of the conduct adjustment agreement as an instrument capable of bringing speed and efficiency to the resolution and compensation of divergences in environmental issues for the promotion of One Health policies, which permeate the health of the environment and its integration with human and animal health. Therefore, the objective of this study is to demonstrate that with the need to preserve the environment and the existence of legal alternatives in relation to environmental protection and conflict resolution, it is possible to use the conduct adjustment agreement as a way of aligning progress with preservation with a focus on One Health, aiming at the harmonious coexistence between humans, animals and the environment. The qualitative methodology follows the procedures of documentary work through descriptive bibliographic research. Five Conduct Adjustment agreements signed in the Municipality of Fernandópolis were analyzed as examples. The results of the examples cited indicate that the terms of conduct established in environmental conflicts can be an alternative for the preservation of the common good, since it is necessary to consider that socio-environmental changes affect the health profile of a population with effects that go beyond territorial and temporal limits.

    Avaliação dos impactos ambientais causados pela construção da Br-242/TO

    The environment is not just important for the economy or for social well-being, it is an essential good for human life. The environmental impacts resulting from anthropic actions are directly responsible for the spread of cities, with their social, economic and political interconnections. Socioeconomic growth gives rise to the demand for road construction, which makes it possible to transport goods and people. The theme of environmental impacts generated by the construction and/or implementation of highways in Brazil is extensive and studied, both internally and externally, and generates an improvement, both in science and in the behavior of actors, by seeking to minimize these impacts. This work aims to demonstrate and analyze the results of environmental reports from the following programs: a) Vegetation Suppression and Flora Rescue; b) Wild Fauna Scaring and Rescue; c) Execution of the Monitoring Program for Water Bodies produced between 2016 and 2019 and carried out within the scope of the execution of environmental management services for the construction and paving works of the BR-242/TO highway. In the methodological path, we will use the reports produced that accompanied the activities developed in the field, regarding the suppression of vegetation and rescue of flora, driving away and saving wild fauna and the monitoring of water bodies, during the paving of the BR-242, in the State of Tocantins. The analysis of these materials will allow us to observe how these processes of environmental mitigation took place, assuming that every landscape that receives roads is associated with the occurrence of negative impacts on biotic integrity, both in terrestrial and aquatic ecosystems. Concluding the importance of environmental management in the implementation of the BR-242/TO Highway is explained in this study, when we demonstrate the implementation of environmental programs to minimize negative impacts and maximize positive impacts on the environment. The set of these reports made it possible that, before, during and after the work, significant environmental impacts to the environment of Tocantins were reduced, resulting in environmental sustainability in the work process and gains for the environment and the community in which the BR-242/TO was built.
