Item Licenciamento ambiental da aquicultura no Estado de São Paulo(Universidade Brasil, 2021) Secanho, Antonelli Antonio Moreira Baracat; Mansano, Cleber Fernando MenegassoA major challenge of the current society of the 21st century is the search for conciliation between guaranteeing an ecologically balanced environment and the exploitation of economic activity, such as aquaculture. Thus, the objective of this work was to address the issue of environmental licensing in aquaculture: the balance between environmental protection and the activity of aquaculture, under the bias of constitutional guarantees of the intergenerational right to an ecologically balanced environment; the free exercise of any work, craft or profession and the valuation of human work, as a way to ensure the dignified existence of the fish farmer, according to the dictates of social justice, in order to reconcile these guarantees that limit potentially polluting activities, with the need socio-economic status of aquaculturists for family subsistence. Furthermore, it is certain that the bureaucratization of the environmental licensing institute ends up, on several occasions, harming the small producer, as the operational and legislative difficulties make the aquaculture's low economic power prove to be an impediment to obtaining environmental licenses. The methodology used was supported by a literature review and relevant specific legislation, in addition to Brazilian jurisprudence. The research was qualitative and quantitative. The study site focused on the entire State of São Paulo. One of the possible solutions reached is the application of the Environmental Licensing Booklet, in order to optimize the production of fish and the protection of the environment.Item Reserva Particular do Patrimônio Natural (RPPN) no Estado de São Paulo: legislação, implantação, panorama atual e estudo de viabilidade econômica(Universidade Brasil, 2021) Oliveira, Osiel de Almeida; Vazquez, Gisele HerbstPrivate Natural Heritage Reserves (RPPNs) are the only category of official Conservation Unit whose owner is not the government, but the private sector. This fact demonstrates a great potential for the private sector to be increasingly participative in the preservation, protection and recovery of Brazilian biomes. The objective of this study was to understand the characteristics and legal aspects of the RPPNs, all the steps to be followed for their registration, as well as to analyze the economic viability of the RPPNs located in the state of São Paulo. For a better understanding of this subject, the scope of this study was to collect data on specific legislation for RPPNs in the state of São Paulo, regardless of the application of such laws. A survey of statistical data was carried out on the RPPNs of the state of São Paulo, as well as on their tax benefits and incentives. As an integral part of the literature review, a complete description of the steps to be followed for the registration of an RPPN was made. Finally, a survey was carried out through a questionnaire, for a sample of 25 RPPNs, in order to obtain data on the current reality of the RPPNs in the state of São Paulo. It was concluded that the main motivation for the creation of the RPPNs was the awareness of biodiversity preservation. The housing deficit, added to the fact that property values in the most central regions of large cities have higher values, the population seeks alternatives to live with their family. In this step, they seek to establish themselves in the periphery and often, in areas of water sources, buying properties built improperly, without any registration or legal authorization to do so. Still, if they do not buy ready-made real estate, they simply invade and occupy these areas of water sources, which should be protected, and build their homes. The objective of this study was to analyze the omission of the Municipality in the inspection and attitudes to avoid the invasion, occupation and possession of the springs areas and responsibility with the people who have already occupied these areas and took possession, in view of the Municipality's omission. The methodology used was supported by bibliographic review and relevant legislation, in addition to jurisprudence. The research was qualitative and quantitative. The study site focused on the Billings Dam located in the city of São Bernardo do Campo in the State of São Paulo. The possession, invasion and occupation of the watershed areas brings social, economic and mainly environmental consequences, which will be analyzed in this work, especially the latter. There is specific legislation for the use of water source areas, which will be the object of this study and which, unfortunately, are not obeyed by the population and the municipality, omitted, becomes responsible for not overcoming those illegal situations. Although there are Public Policies regarding housing, health, environment and education, they are not enough to meet the population's needs. One of the possible solutions analyzed is Environmental Education, formal and informal, to raise public awareness, as well as the intensification of enforcement and effective enforcement of laws.Item Gerenciamento dos resíduos de serviços de saúde do município de Ilha Solteira - SP(Universidade Brasil, 2020) Maciel, Lucimar Milheviez; Tagliaferro, Evandro RobertoBasic Health Units (BHU) and Family Health Strategy Units (FHSU) are facilities that provide basic care services to the population of a municipality. The management of Waste from Health Services (WHS) generated by these units takes place in interdependent stages whose purpose is to preserve the well-being of the employees, conserve the environment, and provide security to the population. In Brazil, there is extensive legislation that regulates the issue with the generating units. This study aimed to analyze the management of this Waste from Health Services in Basic Health and Family Health Strategy Units in the municipality of Ilha Solteira, between 2011 and 2018, using bibliographic and documentary research, combined with observation and photographic record of the management actions adopted by the municipal administration. They found that the municipality has an Integrated Solid Waste Management Plan that, since 2012, establishes the correct management of waste, as an obligation of health managers and other workers of these institutions. According to the collected data, a gap between the knowledge of health professionals regarding Health Services Waste and the conceptual aspects of this subject can be observed. As a result, the definition of "Health Services Waste" is confused with that of "Infectious Waste", and other terms are used to refer to this type of waste; training and awareness on the co-responsibility for these residues during the processes of generating, handling and final destination of these residues in a correct manner is insufficient. The efficiency in providing these services is a constant concern, but there is a lack of attention to fundamental issues. They concluded that the system needs further improvement. Investments in continued education, training of health professionals and clarification of the population are fundamental for the solution of issues involving the proper management of WHS and the correct implementation of legislation.
